Pettit relieved of duties for remainder of contract

For the second time in less than a year, Douglas Unified School District Superintendent Earl Pettit was placed on paid administrative leave by the district.


And, it does not appear it will happen a third time.

The District Governing Board voted on Tuesday evening, January 12, to place Pettit on leave until the end of his current two-year contract, June 30, 2010.

It will cost the district approximately $51,000 to send Pettit home for the remaining five and a half months of the contract.

The 3-2 vote (Board President Charles Hoyack and members Ed Rivera and Patricia Lopez voting for the move, and Susan Kramer and Mario Ramos against it) came near the end of a four-and-a-half hour meeting.

Following an executive session, Hoyack made the motion to relieve the Superintendent of his duties in light of the board’s more thorough review of the investigative report (which was presented at the last meeting).

“Are we going to continue to doing this over and over. It is getting a little bit tiring for everyone,” Kramer said.

Her initial motion was to take “No Action.”

She continued, “This really isn’t a good time. Lets just get on the with business of the district. Where’s our concern for improved quality of education for the district?”

Ramos pointed out that if would be difficult to find someone now.

“There have been a lot of key resignations,” Kramer said and she wondered how another loss of an administrator would impact the district.

During the discussion, Pettit said that 14 times some discussion of his employment had occurred during meetings without an opportunity to defend himself.

During his motion, Hoyack said Pettit had helped create a hostile work environment in the district, and his access to the report comprised the confidentiality promised to district employees.

Kramer repeated her concern about paying Pettit to sit at home and then having to hire someone else to finish out the year.

In a discussion about who would take over while Pettit was gone, the Superintendent said he wrote a  memo on December 22 to the administration setting forth the chain of command.

This only seems to anger Hoyack more since no such memo had made its way to the board.

Pettit then expressed his concerns near the end of the process when Deputy County Attorney Anne Carl, who is serving as the district attorney in this matter, presented a letter to board loosely outlining his Pettit’s duties and responsibilities during this five and a half month paid administrative leave.

“Why is this on district letterhead before anything was even approved by the board?”

Carl said the letter is basically the same letter that Pettit was presented when he was placed on administrative leave last year

At the end of the session, Ramos suggested that the board contact the Arizona School Boards Association to seek their assistance in finding a retired superintendent who might take over during the remainder of the school year.

The board also discussed and approved the release of the redacted 300 page plus investigative report on the Superintendent.

After an executive session, the board approved to release any correspondence through December 23, 2009, between Anne Carl or any member of the Cochise County Attorney's Office and any DUSD Board member regarding the investigation of Pettit by a 3-2 vote.

Based on legal advice, they refused to release any correspondence between Carl and Investigator Pat Cooper or any notes, reports or transcriptions provided to Carl by Cooper.

By a 4—1 vote, the board voted to release the properly redacted report by Cooper. They refused  to release transcripts and interview or exhibits until they have been received by the district and the board has an opportunity to review them.

At the special meeting on January 19 (after presstime), the board  will discuss the release of the redacted transcripts, as well as selection of an interim superintendent and begin the process of selected a new administrator.

    " To answer your question about where this information can be found... If you search the local papers (WMIcentral) you will see all the problems that happened in Whiteriver. Most of these are similar if not the same issues that occurred here. Yes Mr. Pettit did get an award in the beginning of his term, but just because you get one good thing it does not outweigh the other accusations. Yes change is hard and scary but Mr. Pettit was judged on many other problems. It takes some looking to find the information about what happened at Whiteriver, and I hope you take that time to be more informed. "

    " This is exactly the same thing that Mr. Pettit did when he was in Whiteriver. For everyone who says all of these problems, was Mr. Hoyack in Whiteriver? It is very interesting that the Whiteriver school board and the community had the same complaints as what happened here. I would not wish this mess on anyone, as I am sure Whiteriver felt the same way. The citizens must put the children first and do whatever it takes to make sure everyone working for the district is doing the same. If Mr. Borane also doesn’t take care of it then the parents need to go to the school board. If the board chooses not to do anything about it then the parents should go to the state. As a parent I feel it is very important that we don’t give up or back down when it comes to our kids. There are some VERY shady things happening at one middle school that could amount to a teacher and principal losing their jobs and bringing a lawsuit onto the district. When are the employees going to report what is going on at their schools? I plead as a parent that Mr. Borane you go and spend time at the different schools, and speak to the employees that work there. I think you would be very interested to hear what some of them have to say. I, as a parent, have overheard employees speaking and was appalled by what is going on. It makes me consider moving my children out of the district. "

    " The community needs to stand up and make sure that the house gets cleaned. I think that the entire school board needs to be replaced and also the people that work for the district. People like Mary Good, Leanne Marston, Carrie Towland, Lupe Acosta, Martine Muecke, Denise Evans, Nick Schuerman, and anyone else that has caused this district to be in the shape it is now. What is the point of the office of school improvement! It is a waste of money, and then the board approved many to get 10,000 on top of their normal wages! What happened to budget problems? Another HUGE waste of money is the district coaches. They aren't in the classrooms ever, isn't that what they should be doing? They come and go when they please, getting to work mid-morning, taking a couple hour lunches, and then leaving before 2:00. They get paid a teacher’s salary for that? Then my sister who works at the main office told me that one coach is getting paid over 65,000 because when they drew up the contract they put down the wrong figures! Why is this district wasting money with any decisions they make! Then they are talking about possibly making cutbacks because of the budget? Who ever made these mistakes needs to be let go or fired. This community needs to clean out everyone and start over fresh. "

How can the teachers focus on the children if they are dealing with other things? There are still good things going on in the district, Paul Huber Middle School did a drive for Haiti. I do find it very interesting though that some teachers did not allow their students to participate in the drive. My daughter’s class Ms. Jenkins was one of a few that was encouraged not to bring anything in. Why as a teacher would you tell the students to not care about others? Other than that I feel it was good to try to get the students involved in caring for others.     " I have no problem not putting my name; I along with many others need to have a job. I have seen retaliation happen for making a simple comment in this district. Am I spineless yes, but I also have to do what is smart at the time, and now that means keeping my job. One thing that does bother me is people who don’t work for the district, possibly don’t have a reason to fear anything not putting their name. Do I agree with everything either side has done? Not at all, I even think that cleaning house would be a very good thing. Much trust has been lost in this district and in this community. I trust no one that I work with. Is that sad? I know many coworkers who don’t feel good about being there with all that has occurred and things that have continued to occur. If it seemed like I was one sided, I do have feelings like others. They aren’t really one sided but mixed. Do I know everything that occurred? No, I also don’t think any of us will ever know everything that happened. One thing I won’t do no matter if I am on one side or another is say nasty things about the school board, or Mr. Pettit. I don’t think that it is right, or moral to judge either side when none of us know what occurred. I apologize for my strong wording in the last comment, but one thing I should convey is that every comment that is made doesn’t allow the staff, district and community a chance to rebuild. If you as a taxpayer feel strong enough next time they have an election run for a position on the board. It is very frustrating to people who work in this district to her so many people making nasty comments, but do they show up at the board meetings? What about the different events at the individual schools? There is very little support from parents and others from the community it becomes frustrating. I had less than 25% of the parents for conferences, and that was high compared to other teachers. If this district and this community is going to survive and rebuild everyone needs to work at it and be ready to put in the time. I understand that the community is stressed by everything that has happened, but so is the staff that works there every day. To: Huh- am I nuts? To be honest to continue working for this district many have said I am. I hope they are wrong, I love Douglas. To: OK- I explained why I didn’t put my name. I did not say that the paper was a joke; just that they should only post comments that have names. That would cut down on people writing things they didn’t mean or want other people to know they said. To: Join the crowd- I explained why I didn’t put my name am I a coward yes, but at least I will be an employed one. If there is one thing I don’t think is correct no matter where a person stands on what happened it would be stating downright mean things. I don’t really care who you make the comment about. Do you think Mr. Pettit and his kids like reading/hearing the negative comments, or how about the members of the board and their families. If you would like to express concern personally I think fine, but is saying mean things productive? Really? I know it is not, and can tell you it just brings down the staff members that are trying to get the communities children a good education. Just food for thought, I personally will not be making any other comments. Just remember Karma will catch up to everyone at one time or another. I understand frustration, trust me, I do. My request is why we can’t turn all the frustration and negative into supporting our kids and becoming more active with the schools they attend. Once again I am sorry for the way that I appeared in the last comment, but hearing ALL negative is ruining this district, and consequently our children. Why not show all the people in Arizona that saw the negative stories how we turned things around and are better for it. Let show them how Douglas really is, and that we can come together and do positive things. I would love to hear something positive come out on the news about Douglas. I am tired of the negative about the schools, drugs, and other negative things. We are proud to be from here, let’s show others why! "

Since the report has been posted, it is obvious that at least four key employees that gave statements ever considered the human feelings of the superintendent, or their own professional responsibility for following the district rules. What they reported to the investigator has to be some kind of ethics problem. They knew when they were telling the investigator “their side”, which when the investigator looked, carried no evidence, that somehow there would be enough dirt dug up that they would help Hoyack get rid of his enemy. So why don’t YOU, whether YOU agree or disagree with someone, like or dislike them, also please keep in mind that Anti Hoyack has every right to be anti and promote ways to get rid of any elected official that conducts themselves so poorly. Interestingly, when and if Hoyack and company are ever actually gotten rid of, I would bet it will be more humane and ethical than the way Hoyack got rid of Pettit. And what did the final report say? Pettit did nothing wrong. (Except, perhaps, he failed to suck up to Hoyack and look the other way when Hoyack’s favorite school where Hoyack’s wife sits on the PTSO and volunteers, was breaking the ELL law). "

    " At this meeting, I heard Pettit claim the point that a "hostile work environment" by it's very definition requires action taken against an employee having to do with their employment status and that the only person with a claim of being a victim of such an environment is him. I looked this up and I believe he was right in his statement. Mr. Cooper also did not find any examples of this in the District but noted that he was not investigating the board's actions.

    Let us review this confidentiality piece. Chuck Hoyack asked for the investigation, Chuck Hoyack promised staff they could say what they wanted against Pettit anonymously - which would be illegal and against all personnel policy, Chuck Hoyack denied Pettit any chance to defend himself, Chuck Hoyack led action against Pettit to put him on administrative leave because of Pettit's "access to the report comprised the confidentiality promised to district employees"??? Well of course Pettit has access to the report! The report was on an action against him! What did you think would happen with the report? So Hoyack made a false promise to employees and now Pettit pays the price for it.
    Yes, there is a Hostile Work Environment and responsibility for this lies squarely on the shoulders of Chuck Hoyack for his actions and personal vendetta against Pettit.

    It would be a great thing for the District if the Board ever got SOUND legal advice from someone NOT involved in the investigation itself. I hope they do soon before this costs us even more money and also release the report already! "
